I. II. Prevention Of Terrorism Act, 2002 — Section 4(b) — Constitution of India, 1950 — Article 226 — Code of Criminal Procedure, 1973 — Chapter XIV — Writ of Mandamus — Prayer by petitioner for direction from Court to CBI on how to conduct investigation — As per the scheme under chapter XIV of the Code, Court not authorised to interfere with investigation by police or to direct the police how the investigation is to be conducted.
The Courts are not justified in obliterating the track of investigation, when the investigating agencies are well within their legal bounds. Indeed, a noticeable feature of the scheme under Chapter XIV of the Code is that is kept in the picture at all stages of the police investigation but it is not authorised to interfere with the actual investigation or to direct the police how the investigation is to be conducted.
