“If the tender form for purchase of property showed that the applicant purchaser had specifically offered to purchase the property subject to the terms and conditions of the tender and one of the conditions of tender was the arrears of taxes should be paid by the purchaser in respect of the property, the purchaser is liable to discharge the arrears. The fact that the sale deed recited that the property is free of encumbrances, does not in any way cancel the conditions of his offer in the tender, Section 55(1)(g) of the T.P. Act is not attracted.”
