Civil Procedure Code (V of 1908), O.20, Rule 12 — Future mesne profits — Suit for delivery of possession of suit property and mesne profits — Suit property let out to tenant on monthly rental of Rs.2,500 — Fact not disputed — Plaintiff not claiming higher rent by way of damages or a higher rent till possession is handed over — Future mesne profits, held can be fixed at Rs.2,500 p.m. — Lower court’s order relegating future mesne profits to separate proceedings, held, not correct.
