Civil Procedure Code (V of 1908), O.6, Rule 17 — Amendment of plaint — Suit for declaration of suit property as common lane and grant of permanent injunction restraining defendant from putting latrine etc. in that lane — Suit decreed but remanded on appeal — Defendant putting up septic tank, latrine etc., in the lane during absence of plaintiff — Plaintiff filing application for permission to amend plaint praying for grant of mandatory injunction directing defendant to remove the construction — Claim barred by limitation — Application dismissed on that ground — Held, amendment should be allowed — Question of limitation ought not to. be decided at that stage.
