(A) Societies Registration Act (21 of 1860) — Kendriya Vidyalaya Sangathan (Allotment of Residence) Rules, 1998, Rules 8, 11, 10, 4(4), Rule 8 read with Rule 6 and Rule 3(9) — Allotment of quarters to teachers — Teachers’ refusal to accept the same — Denial of House Rent Allowance (H.R.A.) to said teachers — Claim for H.R.A. by teachers — Tribunal holding that since allotment was made suo motu, Rule 11 is not applicable — Also H.R.A. is part of wages, hence no deduction can be made on account of refusal to accept accommoda-tion — In W.P., held, Authorities have power to allot quarters and that is so even under the Rules — Allot-ment made as per priority list in order, and on refusal to accept said allotment said teachers are disentitled to H.R. A. — H.R.A. cannot be claimed as a matter of right.
