(B) Indian Easements Act (V of 1882), Sec.13 — Easementary right over suit cart track — Plea that there is no other alternative access — Accepted by lower Courts — The Commissioner’s plan’s report discloses existence of alternative cart track — Alternative cart track uneven, water logged and unfit for use — There cannot be a claim on the ground of easement of necessity when alternative pathway is available, though it is inconvenient.
